Tug of War - McCartney and McCartney

Could all of this have been avoided? Very possibly is the answer given by Parveen Lateef, Associate Solicitor, at Mace and Jones, Solicitors based in Manchester City centre.
Whilst Parveen believes that all separating couples should have the right to choose which method of resolution best suits their individual and personal needs, the reality is that if Mr and Mrs McCartney had chosen to proceed via the Collaboration process they could have avoided some of the difficulties that they are each currently experiencing.
Collaboration does however require certain essential ingredients:
- A couple that is willing to meet face to face with a view to discussing all issues between them with the sole objective of reaching an agreement that is fair to both of them and, if relevant, to their children.
- Individuals that are honest and open about their respective financial circumstances.
- A couple that recognises that their personal circumstances may require an individually tailored approach rather than the "standard" approach adopted by the traditional Court process. This enables the couple to prioritise what is important to them and maintain control of the process.
In addition to the above the couple must have the benefit of independent legal representation from Solicitors who are specially trained to undertake Collaboration.
If all the ingredients are present the outcome for the couple should be an early resolution of all issues that reflects the couple's individual and personal circumstances without the time consuming, costly and potentially harmful requirement to attend Court.
Parveen, along with a number of her colleagues at Mace and Jones, is a member of The Greater Manchester Collaborative Family Law Group that was launched on Thursday 1st November 2007 at the prestigious new Civil Justice Centre in Manchester.
