A

Acquisition - The takeover or purchase of a company or property.

Adjudication - The legal process of resolving a dispute. The judge or arbitrator listens to the prepared arguments from all parties and makes a decision based on case law and precedent.

Alternative Dispute Resolution (ADR) - ADR refers to all dispute resolution processes outside traditional litigation approaches.

Arbitration - The hearing and determination of a dispute by an impartial professional.

Audit - Professional and independent examination of a company's financial statements and accounting documents.

B

Bankruptcy - The legal process in which a person declares their inability to pay their debts.

Bond - A certificate of debt issued by a company.

C

Civil Partnerships - The legally recognised union between two people of the same sex. Civil partners have the same legal rights as a married couple.

Cohabitation - Cohabitation refers to a couple living together in a consensual union when not legally married to each other.

Collaborative Law - The process in which the solicitors and their clients agree in writing to reach settlement without court involvement.

Collateral Warranty - A contract which gives a third party rights collateral to rights in an existing contract entered into by two separate parties.

Conciliation - The process by which an independent third party, called a conciliator, meets with the parties separately in an attempt to resolve the dispute.

Defamation - A false statement, either written or spoken, that damages a person's reputation.

Disposal - The sale of a company or property.

Dispute Resolution - The term dispute resolution refers to all processes that are used to resolve disputes, whether within or outside court proceedings.

Divorce - The legal dissolution of a marriage.

E

Employment Tribunal - A type of Court established to resolve disputes between employers and employees regarding employment rights.

Enduring Power of Attorney (EPA) - The Mental Capacity Act 2005 replaced Enduring Powers of Attorney (EPAs) with Lasting Powers of Attorney from 1 October 2007. Existing but un-registered EPAs can continue to be registered after 1 October 2007 (see Lasting Power of Attorney).

Equal Opportunities - The prevention, elimination or regulation of discrimination on the grounds of sex, race, disability, age, sexual orientation, social origin and other personal attributes including religious beliefs and political opinions.

Estate - The assets left by a deceased person which must be distributed under the terms of the will or the rules of intestacy.

Estate Planning - The process of deciding how a person wishes their assets to be distributed on death. The laws of wills, trusts, insurance, property and taxes are all applicable in estate planning.

Expert Determination - A third party process in which an independent third party is appointed to resolve the dispute. The expert's decision is legally binding for both parties involved in the dispute.
