Mace & Jones' Banking and Finance team has particular expertise in the financing of businesses, corporate acquisitions and the acquisition and development of property. We can advise on all aspects of secured and unsecured lending and on the respective rights and obligations of the parties to such a transaction.

  • Preparing, reviewing and negotiating lending and ancillary documentation for acquisitions, management buy-ins/buy-outs, property acquisition & development and refinancing
  • Reviewing, and reporting to banks on, the arrangements for the transaction to be financed, including share and business purchases and property acquisition & development, and ensuring that the bank's requirements are factored into such arrangements
  • Investigating title to property and the terms on which property is purchased or leased, and advising the bank of any problems that may affect debt service or value on receivership
  • Review, preparation and implementation of safeguards of the bank's position during the course, and following completion, of a property development, including collateral warranties and step-in rights, and the inclusion of appropriate undertakings to complete the development in a timely and responsible manner
